These Terms of Service ("Terms") constitute a binding legal agreement between you and Waymind ("the App", "we", or "us"). You acknowledge that this agreement is concluded between you and Waymind only, and not with Apple, Inc. ("Apple"). Waymind, not Apple, is solely responsible for the App and the content thereof.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license also allows the App to be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
You agree to:
GPS and location data may be inaccurate. You follow routes at your own risk. The App is a navigation aid, not a replacement for attentive driving.
You acknowledge that Waymind, not Apple, is responsible for addressing any claims of yours or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Waymind alone, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
Waymind is solely responsible for providing any maintenance and support services with respect to the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
The App is provided "AS IS" without warranty of any kind. Waymind is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Waymind’s sole responsibility.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
IN NO EVENT SHALL WAYMIND, ITS DEVELOPER, OR ANY AFFILIATES BE LIABLE FOR ANY:
ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Maximum Liability: If liability cannot be excluded, our total liability to you shall not exceed the amount you paid for the App (which is $0 for a free app).
You agree to indemnify, defend, and hold harmless Waymind, its developer, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
CRITICAL SAFETY NOTICE:
If you import data from Google Sheets, you are subject to Google's Terms of Service and Privacy Policy. We are not responsible for the availability, accuracy, or security of Google services.
Navigation features integrate with Apple Maps and Google Maps. Their respective terms and policies apply when using navigation.
Your use of the App is also governed by our Privacy Policy. By using the App, you consent to our data practices as described in the Privacy Policy.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the developer resides (Turkey), without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the App shall be resolved through:
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Waymind regarding the use of the App.

The App is intended for users aged 4+. If you are under 18, you must have parental or guardian consent to use the App.
BY USING WAYMIND, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
